NSW:Accused murderer granted bail

A man accused of the stabbing murder of boxing champion JOHN MARCETA has been granted
bail after finding new accommodation away from the death scene.

28-year-old CRAIG CHARLES PITTS has appeared at Sydney's Central Local Court via audio
visual link today He is charged with murdering Mr Marceta, 38, in August at a housing
block in the inner Sydney suburb of Redfern where Pitts lived.

Magistrate Lee Gilmour had previously told him she would grant bail if alternative
accommodation could be arranged.

In granting his application, she ordered that he keep away from Redfern and stay at
a private hotel.

His matter was adjourned to the Downing Centre Local Court on October 6.

WA:Man in hospital after machete attack

A 19-year-old man's in a serious condition in hospital .. after being attacked with
a machete and an axe by intruders at a unit in central Perth.

Police say a 20-year-old man also suffered a deep machete cut during yesterday evening's
attack .. after four men forced their way in.

Two men aged 22 and 27 .. both from Perth .. have been arrested following the attack.

They'll appear before the Perth Magistrates Court today.

New South Wales Treasurer ERIC ROOZENDAAL has confirmed that the state government's
effort to sell a second tranche of electricity assets has failed.

No bids were received for the rights to trade output from Macquarie Generation and
Delta Electricity power stations by yesterday's deadline.

Mr ROOZENDAAL has told ABC radio there was interest from investors .. but they didn't
bid because of uncertainty caused by Opposition leader BARRY O'FARRELL's threats about
retrospective legislation and further privatisation.

The state government had hoped to raise two billion dollars from the sale.

HOBART, Aug 24 AAP - The Greens Denison candidate says he has not given up hope of
winning the now crucial seat.

The Hobart-based electorate is one of four where the result of Saturday's poll remains
unclear, with the prospect of a hung parliament seeming certain.

Greens candidate Geoff Couser sits fourth in the primary vote count behind Labor's
Jonathan Jackson, Independent Andrew Wilkie and the Liberals' Cameron Simpkins.

Mr Jackson holds a 408-vote lead follow after preferences, with half of the electorate's
56 booths recounted.

The Australian Electoral Commission says it could take until next Friday before a winner
becomes clear.

Dr Couser said he is still in the running.

"It's really unlikely, it's a big mountain to climb," he told ABC Radio on Tuesday.

"But there are still 13,000 postal votes to be counted. I'd just like to make the point
that it's by no means definite.

"I'm a fair distance behind, but if I do get past Andrew Wilkie, then I'll get preferences,
and anything can happen."

PERTH, Dec 2 AAP - Firepower boss Tim Johnston may be ordered to attend an examination
of his failed company that would start in Brisbane and be completed in Perth.

Mr Johnston appeared in the Federal Court on Tuesday via videolink from a Brisbane
courtroom, giving evidence in support of affidavits which state he cannot travel to Perth
for the hearing brought by Firepower liquidators.

Mr Johnston has cited health and safety concerns for his failure to attend a Federal
Court hearing last week into the company's collapse, which cost investors around $100
million.

A doctor testified that he did not believe Mr Johnston should be required to travel
by air for about three weeks because of his medical condition, including a cardiac problem.

Judge Antony Siopis, who can order a warrant for Mr Johnston's arrest if he is not
satisfied with the reasons given for his absence, on Wednesday said it may be necessary
to conduct the first day of the hearing via videolink from Brisbane on Friday.

Mr Johnston could then be able to travel by train to Perth to appear at the hearing
which could continue before a registrar in that city on Tuesday and Wednesday next week.

Judge Siopis called a short adjournment while he considers his decision.

Mr Johnston has told the hearing he went to a doctor suffering from exhaustion, chest
pains, fear and anxiety before he was due to travel to Perth.

He said he also feared for his life and the safety of his family if required to go
to Perth. But, he added, he was "unable" to say who it was that was threatening him or
his family members.

Mr Johnston said he had never intended not (not) to go to Perth.

He repeatedly said he did not recall or that he could not remember when asked details
of events leading up to his failure to appear in court last week.

His medical practitioner, Dr Robert Mackay, was also called at Wednesday's hearing
and testified that Mr Johnston was delusional and at risk of complete heart failure.

He said Mr Johnston had come to him complaining of cardiac irregularity and minor delusional
thoughts.

"He was overweight, he was short of breath, he was not sleeping and he displayed minor
delusional thoughts," Dr Mackay said.

"He said he thought people were following him, were after him and trying to harm him."

The doctor said that for the past eight years Mr Johnston had experienced dizziness
while flying, which was getting worse.

Dr Mackay said he had prescribed Mr Johnston the drug Temaze, which reduces anxiety
and deals with insomnia.

Richard Douglas, for the liquidators, said Mr Johnston's affidavits were part of a
"deliberate strategy" to avoid appearing at the public hearing.

NSW: Racing hoons face tougher penalties under new laws

SYDNEY, Dec 4 AAP - Drivers who race their cars and do burnouts face tougher penalties
including jail time under new laws from the NSW government.

The hoons will be stripped of their licences for up to 12 months and will see fines
triple under new penalties for these offences, News Limited newspapers report.

Offenders caught a second time face a prison term of up to nine months.

Under current laws, hoons can be jailed only if their second offence is more serious
-- such as colliding with another car or injuring a person.

Police will be given the power to strip licences on the spot and offenders can be taken
off the road for 12 months.

Fines will be increased up to $3,300 for street racing and performing aggravated burnouts
or doughnuts.

"Car hoons will not only face losing their vehicles but also their liberty," NSW Police
Minister David Campbell told News Ltd.

"There is a very clear message to hoons that if they want to put lives at risk on our
roads, they will face being locked up."

They say detectives found 103 plants and 33 kilograms of dried cannabis on a property

the search command centre at Wentworth Falls.

Police say the body may have to spend another night in the bush before investigators
clear its removal.

Meanwhile .. downcast search teams are returning to the command post at Wentworth Falls

The two other missing teens were found safe and well on Monday .. the day David made
three emergency calls from a mobile phone to say he was lost .. low on water .. and heading
for the Kedumba River.

More than 70 police .. State Emergency Services workers and Rural Fire Service workers
were involved in today's search.

INTERNET companies are to be forced to shield children from a growing tide of pornography.

Ministers are backing the idea of an 'opt-in' system that would mean users having to choose to view explicit sites.

Parents worried about what their children are looking at online would be reassured that inappropriate material is otherwise automatically blocked.

Providers are to be given until the autumn to develop a system based on one already used successfully to restrict access to paedophile sites. If not, laws will be introduced to make them comply.

Culture Secretary Jeremy Hunt said: 'We are telling people that if they do not co-operate in bringing forward measures that will deal with this issue fast, we will legislate and regulate.' There is growing concern about the impact of sexual content on the internet on Britain's children. On average, they start to use the web at the age of eight.

Research suggests as many as one in three under-tens has seen pornography on the web, while four in every five children aged 14 to 16 admit regularly accessing explicit photographs and footage on their home computers.

Half of children say they use the internet alone in their bedroom, making it difficult for parents to effectively monitor their activity.

Only 3 per cent of pornographic websites require proof-of-age before granting access to sexually explicit material, and two-thirds do not even include any adult-content warnings.

Devizes MP Claire Perry, a rising Tory star who has led a campaign for a change in the law, said internet firms should 'share the responsibility' of protecting children.

'The best option would be for the British internet service providers to come up with their own opt-in model and we know they can do it - they worked together brilliantly to block access to child abuse websites,' said the mother of three.

'But if they won't act or are moving too slowly, then I really welcome Jeremy Hunt's commitment to legislating to sort this out.

'We know parents across the country are really worried about their children seeing internet porn and it is time to do something about it.' Under the proposed system, pornographic sites will be blocked until an adult user specifically requests it. Another possibility is a movie-type rating system only allowing adult users in the home to view such sites.

Ministers have held private talks with the main internet providers to urge them to adopt an opt-in system themselves. Some are said to have agreed such a system could work, but other firms argue it would be unworkable.

The biggest providers, including BT, Virgin, BskyB, Orange, Talk Talk and O2, have now been given the autumn deadline to develop a workable plan or face a change in the law. NSPCC policy adviser Claire Lilley said: 'Legal pornography on the internet should be available in the same way as buying an adult magazine or a ticket to an 18 rated film - in other words, only for adults who request it.

'Children can easily stumble across unsuitable sexual images online. If the internet industry gave adults the option to choose to view this material rather having it readily available it would go a long way towards protecting children.' Sheila Eaton, president of the National Council of Women: 'We support the opt-in model for internet pornography 100 per cent. We know that children visit the web for good reasons - schoolwork, information, chat, games and to download music - but research has also shown children as young as eight are accessing pornography.

'Research has revealed some disturbing trends: that pornography leads to acceptance of violent and unhealthy notions of sex and relationships, where women are objects and aggressive behaviour is the norm.' j.chapman@dailymail.co.uk

Perrigo's Partner Synthon Receives FDA Tentative Approval for Levocetirizine Solution - Generic Equivalent to Xyzal Oral Solution.

Brussels -- The first phase of a EUR600 million public-private partnership on the Internet of the Future (FI-PPP) was launched today by European Commission Vice-President Neelie Kroes. The partnership will support innovation in Europe and help businesses and governments to develop internet solutions that will be capable of managing the exponential increase in online data. Whilst so far we have experienced the Internet of connected computers, and connected people, the Internet is now going mobile and it will connect a whole range of machines and objects. The current Internet is simply not capable of managing these future data streams, nor is it able to provide the desired accuracy, resilience and safety. The partnership will explore eight areas where this data revolution could spur innovation and jobs in the mobile, software and service industries. The European Commission has made available EUR 300 million in funding over 5 years, with Europe's research organisations, public sector and industry committing an equal amount to this PPP. Projects launched today will together receive EUR90 million in EU funding (to be matched by other project partners). Boosting and focussing the EU's research, development and innovation efforts is a key element of the Digital Agenda for Europe (see IP/10/581, MEMO/10/199 and MEMO/10/200).

A standardised and interoperable Internet service platform

Commercial Vehicle Group Reports Second-Quarter 2005 Results.

NEW ALBANY, Ohio, July 26 /PRNewswire-FirstCall/ -- Commercial Vehicle Group, Inc. , today reported revenues of $196.1 million for the second quarter ended June 30, 2005, up 107% compared to $94.5 million in the prior-year period. Operating income for the second quarter was $25.8 million, a significant increase over $(0.2) million reported for the same period last year. Net income for the quarter was $14.2 million, or $0.78 per diluted share, compared to $(0.9) million, or $(0.06) per diluted share, in the prior- year quarter. Results for second quarter 2004 include the effects of a $10.1 million non-cash option issuance charge. As a result of the company's August 2004 initial public offering, fully diluted shares outstanding for the quarter were 18.3 million compared to 13.9 million in the prior-year quarter.

Results for the second quarter included the effects of the company's acquisition of Mayflower Vehicle Systems' North American Commercial Vehicle Operations and the effects of the company's acquisition of Monona Wire Corporation from June 3, 2005 forward. Results for the second quarter also included the mark-to-market of CVG's foreign exchange contracts, which positively impacted the quarter on a pre-tax basis by $0.4 million compared to $0.4 million in the prior-year quarter.

Arafat promises elections within a few months.

JERUSALEM _ Palestinian leader Yasser Arafat said Thursday that he would organize presidential, legislative and local elections within a few months, but he did not link them to his previous demand that Israel withdraw its troops before any voting.

"In the winter there will be elections for the open (legislative) council and the presidential election as well," Arafat told Reuters. He added that regional and municipal polls also would take place by the end of the year.

The news agency said it was the first time Arafat had set times for elections without the condition of an Israeli withdrawal. Last week he said elections could be held only when Israeli occupation ended, but in the Reuters interview he said the polls were not conditional on an Israeli military pullback.

His statement seemed to indicate a new level of commitment to reform, but a senior Arafat aide suggested that problems remained.

"That is what he said," said Saeb Erekat, a senior aide to Arafat. "That does not mean that it is not necessary to create the right conditions for the election."

Earlier Thursday, the five members of the Palestinian Election Commission resigned, with some Palestinian observers suggesting that the move was a protest over Arafat's reluctance to set a date for elections.

Other observers, however, said it was nothing more than routine.

Hanan Ashrawi, a member of the Palestinian Legislative Council, played down the resignations.

"Things got blown out of proportion. . . . It's only procedural. It's not a protest. It's a formal legal step," she said.

She said that some of the election committee members have been appointed to other posts and that there is supposed to be a new election committee for every election. She said Arafat had been considering holding elections within six months, by early fall or winter.

Erekat, who is in charge of the logistical aspects of the proposed elections, said 1.2 million to 1.3 million voters had to be registered and he expected about 25,000 candidates. He said conditions in the Palestinian territories would make this difficult.

In response to attacks on Israelis by Palestinian bombers, Israeli authorities have cracked down on Palestinian areas, severely curtailing Palestinians' movement within those areas and transit into Israel.

Israeli officials are suggesting that Palestinian areas be broken up into sectors and that permits be required for travel and movement of goods between sectors. Reports indicate that the permits would have to be renewed monthly. There are also proposals to separate Israel from Palestinian areas with fences.

"Can you imagine under the present circumstances that we would have free registration?" Erekat asked. "To have free elections we need to have the free movement of people."

On Wednesday, Arafat and aides met with representatives of groups seeking to oversee reforms within the Palestinian Authority.

"Various goals of reform were discussed," said Christina Gallach, an aide to Javier Solana, the foreign minister for the European Union. She said representatives of the EU, the U.S., the U.N. and Russia were part of the discussions concerning Palestinian progress toward free and fair elections, security guarantees and transparent forms of governance.

Mobile phone that lets you watch TV and surf the Net.

IMAGINE a mobile phone that allows you to watch football, listen to pop music, book a flight or order your week's shopping from the supermarket.

It will soon become a reality. The technology for this exciting communications revolution is to be launched within two years.

The idea of combining a video telephone with a TV set, personal computer and Internet access promises a commercial bonanza for operators, better services for users and a [pounds sterling]1.5billion windfall for the Government in licence fees.

Already some 13 companies are lining up financial bids for a licence to operate Third Generation - or 3G - mobiles in Britain.

Tesco, Richard Branson, George Soros and Paul Allen - who set up the world's largest corporation, Microsoft, with Bill Gates - are among those keen to win a slice of the action.

Industry experts believe there will be a billion mobile phones offering Internet access working around the world by 2003. Advances mean it will be possible to transmit huge amounts of data at incredible speeds to the new handsets, which will offer video phones with clear, moving pictures.

The technology behind 3G phones is called the Universal Mobile Telephone System (UMTS), which will be launched worldwide in 2002.

However, the UK could get there sooner.

While UMTS will offer the ultimate in speedy access to Internet and video services, several companies are currently developing existing technology to introduce some of these benefits to consumers earlier.

Already BTCellnet has a limited Internet access service known as Genie, which can flash up news headlines or the latest football scores to 400,000 subscribers.

Orange has gone a step further with High Speed Circuit Switched Data phones, costing around [pounds sterling]130 and offering much more extensive access to the Internet.

The operator will soon push the technology a step further by offering mobile video phones at a cost of [pounds sterling]1,000 a pair.

The next major breakthrough will come within six months with the launch of General Packet Radio System (GPRS) mobiles, which will allow for the transfer of Internet data at much faster speeds.

The scale of the technological advances is demonstrated by the speed at which the handsets can receive and process data.

Most existing mobiles work on the basis of receiving 9.6 kilobits per second, while the Orange system, or HSCSD, is around three times faster at 28.6 kilobits.

The GPRS technology takes the networks to a new level of sophistication with the ability to cope with 56 kilobits of information per second.

But the 3G phones now at the centre of a bidding war will be capable of processing 2000 kilobits of data per second, providing enough power to surf the Internet while having a video phone conversation.

BTCellnet spokesman Damian Peachy said: 'Everyone has seen the explosive growth of the Internet in the last couple of years.

'Imagine combining that power and access to information with the portability of a mobile telephone.' He gave an example of a football fan being suddenly alerted by the phone to a goal by his side in a key game. One click would replay the action on the phone's screen.

A video phone would, it is claimed, bring families closer together while it could be used to talk to the family doctor rather than make an appointment.

E-commerce Minister Patricia Hewitt said: 'The prospect of one or more new mobile operators, and the increased competition and innovation that this will bring, is good news for both UK consumers and the economy.' Greater competition would spur the faster introduction of improved services, fresh approaches and cheaper prices, she added.

Recently, a rather heated discussion erupted in the comments section of the Accounting Tomorrow blog - appropriately, over the use of the Internet.

More specifically, the scuffle arose over the use of this modern tool of communication to e-file. Blogger Jody Padar broached the topic of the Internal Revenue Service mandate, asking firms that have yet to utilize the decade-old process, "What's up with that?"

Plenty, it turns out. "If the IRS had made it easier and simpler to e-file," wrote one commenter, "many CPAs would have adopted the concept some time ago ... . And most of my clients are of the older generation and want nothing to do with e-filing."

This level of e-comfort often marks the clearest line in the sand between Baby Boomers and Millennials - both accountants and, clearly, their clients. While younger clients might scoff at overstuffed file cabinets, those filing on paper for decades would just as quickly question the security of online transmissions of private data. "I am wondering just how long it will take (not if) until some hacker figures out a way of penetrating the IRS," pondered one commenter.

Another commenter displayed even greater skepticism: "The reason I haven't e-filed until this year is that I did not feel like being treated like a criminal and fingerprinted. But now it's mandatory, and I'll go to my local police station and give them my prints."

Many, however, agreed with Jody's push to the future, with one classifying it as "a simple evolutionary change, not revolutionary."

Brussels, -- The European Commission has opened a formal investigation under EU state aid rules to examine whether the restructuring plan of Czech Airlines (?SA) is suitable to restore the company's long-term viability and whether the proposed reduction in activities will be sufficient to off-set the distortive effect of the aid it received. The opening of an in-depth investigation gives competitors and other interested third parties, as well as, of course, the government and airline concerned, the possibility to comment on the measures under examination. It does not prejudge the outcome of the investigation.

Commission Vice-President in charge of competition policy Joaquin Almunia said: "Rescue and restructuring aid is one of the most distortive types of State support. When this happens, the Commission must make sure the company contributes its fair share of the burden and that it is ultimately viable without further State support."

The Commission has opened an in-depth investigation, to verify whether the measures notified in the context of the restructuring of the Czech national flag carrier Czech Airlines are in line with the EU rescue and restructuring aid guidelines. The measures comprise a loan of CZK 2.5 billion (around 94 million euro) granted by the State-owned undertaking Osinek under allegedly preferential conditions (see ongoing case C6/2010), its later de-collateralisation and transformation into equity capital and; a potential guarantee for the purchase of an airplane.

A company in difficulty may receive state aid under strict conditions, which are set in the 2004 EU guidelines on rescue and restructuring aid (see IP/04/856, MEMO/04/172). The aid must be accompanied by a restructuring plan that will restore the long-term viability of the company on the basis of realistic assumptions. As rescue and restructuring aid is one of the most distortive types of state support, it must be accompanied by measures compensating the distortive effect of aid, such as reduction in capacity, in market presence or in entry barriers. Finally, the beneficiary needs to make a significant own contribution to the costs of restructuring.

At this stage, the Commission has, in particular, doubts about:

when exactly Czech Airlines became a firm in difficulties. Under the information presently available, the Commission considers it has been in difficulty since at least the second half of 2009 when it started a restructuring process;

the extent to which, the Prague Airport, with which the government plans to merge with Czech Airlines, could contribute to the restructuring process;

whether the loan from Osinek can be considered as being part of a single restructuring operation together with the other measures;

the adequacy of the restructuring plan to restore the long-term viability of Czech Airlines;

whether the proposed compensatory measures will adequately address the distortions of competition brought about by the aid;

whether the company's proposed but not yet implemented own contribution to the restructuring costs can be considered as genuine and whether its proportion in the restructuring costs would not be altered by the merger;

whether the aid would not provide surplus cash for activities not linked to the restructuring.

The opening of a formal investigation procedure is common for state interventions in the aviation sector, in particular where the beneficiary seems to be in a difficult financial situation. It gives interested third parties, Member States and competitors the possibility to submit comments on a series of measures carried out in a highly competitive market.

The Commission in the past has had to analyse and set conditions to rescue and restructuring aid to many Europe's flag carriers to ensure they contributed their share of the restructuring burden and were viable without further State support. In December it also stared an in-depth probe into aid to Hungary's Malev and it is monitoring past decisions. For ongoing cases and past decisions go to:
